A Ray of Economic Hope: Corporate Clients Have Plenty of Cash
There's a ray of light in the economic gloom affecting law firms: many corporate clients have plenty of cash and little debt, and are well-situated to get through the recession, according to the New York Times.
The concern in the legal community is that corporate clients will start demanding rate freezes or discounts, following the direct challenge spearheaded by the Association of Corporate Counsel (ACC) against law firm rates. (See They Say They Want a Revolution: Reconnecting Legal Costs to Value Delivered, subscription required.)
But Jason Trennert, managing partner and chief investment strategist at Strategas Research Partners in New York, who said his own rough examination of corporate balance sheets shows that “cash, as a percent of total assets, is as high as it’s been since the 1960s.”
- At Paychex the ratio of cash as a percent of total asserts has grown from 30% in 1988 to 70% by last year.
- Apple's cash ration grew from 38% to 60% over the same time period.
- Microsoft's cash on hand is so large that it could pay out the $20 billion cash component of its pending hostile takeover bid for Yahoo from its own reserves.
High cash ratios exist across many industries, including apparel, manufacturing, engineering, retail, healthcare and technology companies.
Meanwhile, a study by at Ohio State University shows that corporate debt has fallen sharply. The net debt ratio, or debt minus cash as a percent of total assets — fell so sharply that, by 2004, it was below zero, where it stayed at least through 2006.
“In other words,” the researchers noted, “on average, firms could have paid off their debt with their cash holdings.” Innovations like "just in time" supply chains and faster payment systems have cut accounts receivable, cut debt and raised cash reserves.
Ideally this means that corporations will spend their "overstuffed wallets" on litigation, mergers and acquisitions and corporate work done by law firms.
As recently as October 2007, an ACC/Serengeti survey revealed that corporations expect their law firms to increase their rates by 5.3% up to 6% on hourly rates in 2008. The same report found that the balance of fee-setting power favors law firms, hourly rates will continue to predominate, and cutting fees is not the top client priority.
Maybe 2008 won't be as hard on law firms as they expect.

Big, Artful Wine at The Modern: Bedell's Musée from Long Island
Some said it tasted of California. Howard Goldberg of the New York Times found it "fairly light and lithe," suggesting left bank of Bordeaux, rather than the typical fatter, weightier St.-Emilions of the other bank. Others felt that the wine was "wound-tight" and needed a bit of time to air, a bit of time to relax among all the exposure. The 2005 vintage was an incredibly ripe one on Long Island, with a hot, dry growing season largely absent of rain, except for a harvest time monsoon that some vineyards, including Bedell, managed to survive. But by the turnover of hors d'oeuvres trays, everyone seemed to agree that Musée felt equally comfortable with arugula quiche, skewered duck with watercress dip, and cucumber-wrapped tuna.
"I'm speaking of Bedell, not Mouton," toasted Pascal Marty, a viticultural consultant from Santiago, Chile, who was partly behind Musée, and who also helped create big, best-selling wines like Opus One and Viña Almaviva. "It has balance, elegance, agility. It has a signature. It is a wine you can identify when you taste it once. That's what makes great wines both different and similar."
Since Musée's release just three months ago, the winery has sold 300 of 800 magnums packaged in individual wood crates. The wine is a keeper, not just because of its collector's edition label. "It could age for 20 years," said Bedell's head of operations, Trent Preszler. The more observant attendees noted the wise selection of a bottle with a particularly deep punt to facilitate decanting. Such bottles are becoming more and more rare, and now shine as pieces of art, just like the wine and label. (The 400-case production is also selling as single bottles for $65 or in hand-crafted wooden boxes of six for $390.)
"I believe Long Island wine has already found greatness and still has great potential," said Alex von Bidder, managing partner at The Four Seasons. "The challenge is still selling it." He took a deeper sip. "This is eminently drinkable. It speaks for itself. I would love to have it with my dinner tonight."
Bonnie Munshin, general manager of Nick & Toni's in East Hampton, called it "yummy" several times and then clarified: "It's full-bodied but not overwhelming."
Which, in some ways, is becoming indicative of Long Island's cool, maritime terroir: moderate alcohol levels which do not overpower the fruit flavor, and fruit flavor nuanced enough that it doesn't overpower the wine. "It's fruity, but it's like a good fruit," said Marty. "It's not like when fruit is too ripe and it becomes bad. It's like a perfect peach or apricot."
As for the artist's contribution to the wine, Close explained that he was momentarily stumped when he received the refrigerated container from Bedell with a cluster of just-harvested grapes. "I didn't know what to do with it." He ultimately configured the fruit and errant leaves into a timeless pose reminiscent of Greek nudes. Close, who is old friends with Lynne from their mutual days as fathers escorting children to the New York City bar mitzvah circuit, has already been invited to do labels for a major European wine maker. "I can't do grapes again," he sighed to an assistant. "I have to come up with something different."

Branching Out in the Lone Star State On June 1, 2007, the State Bar of Texas officially launched the Texas Bar Circle, the first social networking site for lawyers provided by a state bar organization. Has the site caught on since its rollout?
Definitely yes—as of this writing, more than 2,200 lawyers have joined it. “We knew that lawyers are social animals, and that their success depends on their ability to network with peers and build connections,” says John Sirman, Web manager of the State Bar of Texas. “We saw our members as a group ideally suited for and in need of social networking tools. To me, this concept was a no-brainer and an inevitable offering by any bar association.”
The social network is “closed,” in that only members of the Texas bar can participate. Because the members are all known individuals, the closed network helps to minimize many of the concerns that exist with public sites like MySpace and Facebook. Members sign up using their bar number and automatically have access to their own “Home Page.” This page contains a calendar, announcements and news, links to new members in the Bar Circle, and other information. To add friends to their networks, users click on People and browse for other members, and then the other person receives an e-mail asking him or her to accept or reject that invitation.
A common part of joining a social network is the creation of the member profile, to let others know more about you. The Profile page on the Texas Bar Circle site has areas where members can add information about their current employment and their education, upload their resumes, and add all of their contact information, if desired. The Profile page also contains a listing of the member’s current friends and groups joined. Users can keep a journal on their Profile page, or upload photos to their photo album and share them with the community.In addition to traditional social networking features, the Texas Bar Circle also offers a Careers page, where users can browse for jobs or post job listings of their own. The Discussions area allows members to converse about virtually any topic. And coming soon to the site will be the ability for members to add their specific practice areas to their profiles.
Members are also able to create their own groups, and as of this writing, there are more than 90 groups, ranging from law school alumni groups to practice-specific interest groups, to Lawyer Moms, Christian Attorneys and Musical Lawyers.
Sirman has seen some interesting things happening in the interest groups. “People really are using it to make new connections with people they may not otherwise have met. A fun example is the Art and Photography group, where there are some real artists sharing their work by uploading photo albums. Or Rainmaking, where members are making new business connections. With the Bar Circle, our members have a way to connect statewide that couldn’t exist without this platform.”

My friend Marianne Richmond details a very frustrating story of how HP is playing games with the education of Sam - a high school freshman - whose HP laptop has been zonked (I think that's a technical word) since November 2007 .. with no resolution dispute hours with tech support, emails to bloggers, on and on. What adds insult to injury is that this is the company that boasts not 1 or 2 or 10 or 15 or 20 but over 50 HP blogs along with podcasts and other social media initiatives. There is even one about social media by Scott Berg. They all mean NOTHING because internal processes are broken.
HP, I'd like to introduce you to two of your customers Sam and his mom Marianne, who are about to go MAC. Well, HP you might say, the loss of one high school student and his mom .. no big deal. It's not like they are a Fortune 100 company where you might have opportunity for an account with hundreds perhaps thousands of orders.
Oh, by the way, HP if you or one of your 50+ bloggers happen to be listening to this conversation, I forgot to mention one minor detail. Mom Marianne is a highly respected blogger. Her post - HP: Customer Experience Disconnect might influence as many potential customers as that one Fortune 100 account.

- Social media changes how we conduct business.
- In developing your social media strategy do not neglect a review of internal processes. How will information be disseminated?
- In the nano second world of the Internet, internal systems must be developed to ensure rapid responses to questions and problems.
- Excellent customer service is not a nice to have .. it's critical.
- Listening in on conversations means NOTHING if you can't take corrective action .. immediately.

Mistake #2: Ignoring long copy.
I know you like to "think" the LOHAS market is just too smart for all that long copy. After all they are made up of wealthy CEOs and soccer moms. Don't be ridiculous. They are a very educated segment of the population which means they make informed decisions. Just like anybody, when it comes down to making a buying decision, LOHAS want all the facts. Long copy continues to prevail because it WORKS. Now long copy for the sake of being long is plain stupid. You want copy that overcomes objections, makes a solid case, and answers all the questions in the prospect's mind.
Mistake #3: Not capitalizing on celebrity endorsement.
Ed Begley Jr. is a fixture in Studio City where I live. He has been known to ride his bike to work way before it was cool to look at alternative fuel options. Now he has launched his own environmentally safe cleaning products called Begley's Best. Ed's endorsement means something. If you tie a celebrity to a green product, it means instant credibility so you have a much better chance of succeeding in the LOHAS market.
Remember, you can market to the green folks, using many of the same marketing principles you would use for the regular joe. Come from an authentic position and be respectful. Soon they'll be showing you the green.

Every webmaster should have some basic understanding of these simple SEO techniques if they want to achieve Top Rankings for their site. The more you know about these Search Engine Optimization techniques; the better your web pages will fare in the different search engines, especially Google.
Optimizing your pages for the search engines should be your main priority because conquering and dominating your chosen keywords is often cited as one of the major determining factors in the success of your online site or business. You must have a rudimentary grasp of how SEO can work for you and your site.
These simple SEO Tips will help you understand the basics and help you reach your online goals.
1. Title Tag
The Title Tag is located at the top of your html page and it tells the search engines what your page is about. When you open your page in a browser these are the words at the very top of the screen. Despite its simplicity, the title tag is crucial to 'on-page optimization'; it should include your main keywords and it should be 63 characters or less if you want your title to appear in full on Google.
Many SEO experts create web pages in a three-prong approach. They place the title in:
- the title tag - on the webpage itself - and in the URL for that page
Sometimes they will just pick the main keywords from the title and place them in the anchor url instead. For example: www.yourwebsite.com/keywords.html
2. Meta Description Tag
The Meta Tag contains the description for your web page. Your description will show up in all the search engines so you have to be careful to write precisely and objectively. It should be about 140 characters or around 20 words. Make sure to include your keywords but don't spam - don't repeat your keywords more than twice, using variations is helpful.
Keep in mind, successful webmasters make their descriptions stand out from the crowd and entice the surfer to click their link. It is also the first contact with your potential visitor or prospect so make a good first impression.
3. Anchor Tag or URL
The anchor tag is used to form links within websites or from site to site. This tag should have your title or the main keywords from your page title to be the most effective.
Anchor text is also important to know, these are the underlined, clickable text or words in a link. <*A HREF="url"> anchor text <*/A>
If you want to check Google for all web pages containing your keywords in the anchor tags.
Just type into Google Search:
allinanchor:yourkeywords
4. Finding Backlinks
One of the keys to higher rankings is building quality links from relevant related quality sites. The search engines, especially Google, counts each link as a "vote" for your site or content. Many experts suggest you include your main keywords in the anchor text of these inbound links in order to rank high.
If you want to find the number of backlinks your site has.
Just type into Google Search:
link:yourURL
and it will give you the number of backlinks you have.
Google doesn't give you all your existing backlinks, so you can try Yahoo! to find a more exact number.
Just open Yahoo! and type in: linkdomain:yourURL
5. Checking Indexed Pages
If is very important for you to know what content the search engines have indexed from your site. You can also check to see how your links are displayed and to see if any titles or descriptions are missing from your pages.
You can see how many of your pages are indexed in Google by using the site command.
Just type into Google Search:
site:yourURL
Another way to look at your pages in Google is to type in "http://yoursite" and "www.yoursite" with the quotation marks to see the exact number of listings for each.
6. Checking Google Cache
You can also check to see the Google Cache of your site by using the cache command. You will also discover when it was last retrieved.
Just type into Google Search:
cache:yourURL
7. Finding Associated Keywords
Keywords are the heart of the Internet, you must dominate the search engines for your chosen keywords if you are to succeed online. So make sure you have your main keywords in the Meta Keyword Tag on your page. Many experts suggest you place your page's main keywords in the first and last 25 words on that page.
You must also be able to find and use variations of your keywords to completely conquer your targeted niche. To find what other keywords Google has associated with your main keywords, just use the tilde ~ command to find associated phrases in Google.
Just type into Google search:
~keywords
Variations will be highlighted in bold print.
8. Finding Titled Keywords
If you want to find competing sites that have your keywords in the title just use the allintitle command.
Just type into Google search:
allintitle:yourkeywords
In summary, if used consistently, these basic SEO techniques should help improve your rankings and keep you in the picture with regards to your standings in the search engines. Your site's stats or raw traffic logs will also confirm the rise or fall of your keyword rankings. You must have complete knowledge of both your site and your keywords in the search engines, especially Google. Since Google will deliver most of your quality traffic, you must optimize for it and be aware of what is happening to your site and keywords within Google. Uber Affiliate Marketing Guide Update
My Uber Affiliate Marketing Guide was in much need of an update. So I figured since I was launching the new theme, I’d also go ahead and update the guide.
Due to Diorex taking down his blog, a pretty large number of article links were broken. He ran a great blog and provided a lot of great information, and this hit the blog. So I peppered in some relevant articles and guides of my own, as well as pulled different articles from around the net.
Check out the new guide and read any of the new articles that you may have not read before, it’ll take you one step closer to becoming an Uber Affiliate.
Google Adds New Factor Into Quality Score
Adwords came out and introduced a new factor into rating a landing page’s quality score.
As part of our continuing efforts to improve the user experience, we will soon incorporate an additional factor into Quality Score: landing page load time. Load time is the amount of time it takes for a user to see the landing page after clicking an ad.
Why are we doing this?
Two reasons: first, users have the best experience when they don’t have to wait a long time for landing pages to load. Interstitial pages, multiple redirects, excessively slow servers, and other things that can increase load times only keep users from getting what they want: information about your business. Second, users are more likely to abandon landing pages that load slowly, which can hurt your conversion rate.When are we making this change?
In the next few weeks, we will add load time evaluations to the Keyword Analysis page (we’ll notify you when they are available). You will then have one month to review your site and make necessary adjustments.After the one month review period, this load time factor will be incorporated into your keywords’ Quality Scores. Keywords with landing pages that load very slowly may get lower Quality Scores (and thus higher minimum bids). Conversely, keywords with landing pages that load very quickly may get higher Quality Scores and lower minimum bids.
In my opinion, this won’t make any difference on a good affiliates campaign; in fact I think it will help give them a higher quality score. I’ve said it before that load time is a very important thing, not because it’s now a factor in quality score, but because it plays a big role in conversion rates. Some of the crappiest landing pages have the highest CTR because the image quality is simple and very low sized. This makes the page load lightning fast, we have to remember that some people are still in the stone age and have dial-up connections. You only have so long to capture a visitors attention, and seeing a blank page certainly skyrockets their chances of leaving before they give it a looooong chance to load up.
So upgrade your hosting if need be, make sure your images aren’t 10MB a piece, and start using GIFs or compressed JPEGs. Now will load time not only increase your click through rate and overall profit, it’ll help your quality score as well.
UberAffiliate Makeover!
So this is the launch post for my new theme, hope you guys like it a little better than the previous one. I wanted it to be as similar to the old one as possible so it wasn’t a huge change for my readers, but I did want a couple features changed and the whole thing touched up. I had Unique Blog Designs do this project for me, and I think they did a great job and would highly recommend them. They’ve done big time bloggers themes such as Shoemoney and John Chow. I worked with Nate and Matt, and they’re a great company to work with. They had my concept up fast, made revisions fast, and were always there to chat either via IM or email. If you’re thinking of starting a blog, or think yours needs a touch up like mine did, UBD ftw.
So now onto a few of the changes in the blog that I think are for the better :
- A header that actually is a clickable link that takes you back to the home page haha.
- I replaced that ugly spot for the 468×60 banner with a 728×90 leaderboard underneath. It’s a big banner but I actually think blends in rather well and isn’t too distracting.
- New section for popular posts and RSS information. I wanted something like this without doing the super popular three sections across the header.
- New post title setup. The old one was really boring and got the job done I guess, but this one looks prettier and is more sectioned off.
- Rotating 125×125 ads, yayyy my advertisers all get equal exposure now. I actually have some 125×125 ad spots left, so contact me if you want one.
- I have one of those neat looking footers now.
Overall I think it’s a really nice little upgrade from what I had before. The previous theme I designed 100% by myself and I thought it was good and unique, but just a little choppy in areas and could use some improvement. Thank you Unique Blog Designs!
What really matters though is what you guys think, after all I’m writing to all of you, not myself. So let me know that you think.
Google Adwords Mega Slap
It seems like I’m not the only affiliate who’s been affected by Adwords going nuts on a ton of accounts. I logged in yesterday to see a lot of my search campaigns slapped with $5.00-10.00 minimum bids. They must have done a quality score update, because people are getting slapped left and right.
For example, I’ve had one campaign running since November, so about a solid 4 months. CTR has been 14% lifetime for that campaign overall, and my quality score was great 100% of the time with $0.02 minimum bids. Spending was about $2,700/day on that campaign. Landing page was fine, links, content, etc. it was a functional site. Does this deserved to be slapped? I didn’t think so, but apparently Google did. They went on a spree or something, because most of my search campaigns on personal AND corporate accounts got slapped. I’m sure once I call up Google they’ll hopefully be able to do something about it and remove the slap, but it seems like they did some default automated action to go in and jack up everybody’s bids. There’s a discussion going on about this at Wickedfire, so you and I aren’t the only ones that have been slapped. Here’s a quote from that thread :

And I have been slapped 980 degrees around.
It seems that even those with huge content sites are getting slapped as well.
Am I no longer an UberAffiliate and going broke? Haha nooo, my income has taken a slight to moderate temporary hit, but things will bounce back and my accounts will be running fine soon enough. It just goes to show to definitely not put all your eggs in one basket. If you were making your living on one Adwords search campaign and this happened, you’d have no bread money until it got fixed.
I do believe this was just one of the infamous Quality Score slaps, and it has something to do with my landing pages. I have some creative ideas on how to fix this issue so I don’t get slapped again, so I’ll be sharing them if they work out. My landing pages weren’t simple “bridge pages” with just a Continue button and no content, I had a lot of unique content, links, all that jazz. Kinda sucks though because I actually have to sit down and do some work, haha. I’ve been lazy though and busy with getting my house etc, so a good kick is what I needed.

Charity Check Tuesday
EDIT IN : Some people think that I’m trying to scam money and use this to scam you guys for tax breaks. I’m really sorry, but a couple hundred dollars is not doing to put even the smallest of dents into what I owe for taxes. I just wanted to think of a creative way to give to charity.
It’s time to start the first of hopefully more projects to help give back to others less fortunate than we all are. We are all very lucky (and smart) to be in this industry, and I think we’re all able to give 1/100 of what we do back to those who need it. So here’s the announcement of Charity Check Tuesday. I’ve wanted to do something like this for a while now, but wanted to wait until I had a decent readership to do so.
What is Charity Check Tuesday?
Well, the biggest motivation behind this comes from Shoemoney’s Free Shirt Friday. Basically companies send him shirts, and he’ll post a picture of himself with the shirt on and give the company some link love. I think it’s a great way to involve different people in your blog, but I wanted to do something with charity (unless you want to send me a pimp cup…which is sweet haha).
So what I’m asking is that instead of sending me t-shirts, I’m asking that companies send me checks. Every Tuesday I’ll post a picture of me holding a check that’s sent to me and do a little writeup on the company (or person) that sent the check. What I’ll do is every month have a poll, and you guys will vote for the charity of the month. Then at the end of the month, I’ll combine the checks and write one big check to the charity that you guys choose (I’ll take a picture of me holding it so you know it’s not fake). I’ll give it a week or two to let some checks come rolling in before I start to post up pictures. Why Tuesday? I have no idea…
The minimum check amount must be $15. If it’s lower than $15, it won’t be posted on this site. It’s not that I’m trying to get more money out of you, but I can’t go in and cash a hundred $1 checks every week, the bank would kill me and I think I’d kill myself. If a company decides to be awesome and sends a huge check, it will get posted priority before other ones. Other than that, they’ll all be posted as they’re received. In the memo of your check just put your website URL so people can see it on the picture and so I know what to post about as well. You can attach a small note about your company/website as well to help me out a little more. You’re getting some decent traffic and helping a good cause…who could ask for more?

Goal for this month: make money with affiliate marketing
One of the goals I’ve set for this month is to get started with affiliate marketing again and make some small profits (like 250EUR before the end of the month). If successful I’ll try to scale it up and develop it onto a new income stream that supplements my current income. My online business generates a relatively nice chunk of income but it’s not really diversified, the growth is stagnating and I’m kinda worried about the sustainability. Since the holiday season is over income collapsed by 30-40% and the freefall of the dollar isn’t doing me much good either.
To feel a bit more secure I’m going to try to make money with European affiliate networks so I don’t have to worry about the currency exchange. After some market research I’ve decided to start with Flemish affiliate campaigns and later I’m also going to try to target the Netherlands. My decision to focus on these target groups has some advantages but also some disadvantages:
+ Less competition. In the US you have competition from affiliate marketers from all around the world but that’s not the case in my country. That should make my job a bit easier and I think advertising costs will also be lower here because there aren’t as many advertisers.
+ No language barrier. It’s not always easy to advertise in another language if you aren’t a native speaker.
+ It pays out in euro. More diversification and less reason to worry about the dollar going south.
- Affiliate networks and programs aren’t as developed as in the US or UK. At first sight there don’t seem to be a lot of good programs.
- Smaller population: 6 million in Flanders and about 16 million in the Netherlands vs 300 million in the US.
My experiences with affiliate networks are pretty mixed. About 1.5-2 years ago I had a very successful affiliate campaign running that made shitloads of cash with free traffic but after a couple of months it peaked and after a while I had to pull the plug on it because the returns were getting too small for all the hours I had to put into it. All my other attempts to make cash with affiliate programs made use of AdWords but most of these campaigns didn’t give a positive ROI.
Hopefully I’ll do better this time. Right now I’m still in the “analysis, learning and reading” stage but my first new affiliate campaign should get off the ground soon.
Another busy week
This week is going to be really busy as I’ll get flooded by tons of news from CeBIT - this is a European tech show in Hannover, Germany. Most major computer and tech firms will present all their latest products at CeBIT, just like at CES in Las Vegas two months ago.
Hannover isn’t really close to where I live so I can’t bring my own coverage from the show but I hope I’ll get my driver license soon so I can go check it out next year. Posting volume on DV Hardware will go up this week as I’ll try to post as much as possible about all new products and if I find some free time I’m also going to finish a couple of reviews that should have already been published a couple of weeks ago..
Within two weeks there’s also an interesting conference for SMBs in Brussels called Ondernemen 2008. Normally I wouln’t be interested in this but I received an e-mail from Google last week that they’re going to do some AdWords workshops at this conference.
It’s called Google University and there’s a beginner and advanced class. The beginner workshop focuses on the latest trends in online marketing, how to setup an AdWords campaign and how to optimize your campaign. The advanced workshop will offer tips on how to maximize your ROI, best practices to improve your reach on the Google network and tracking and analysis. People who attend the workshop will receive a AdWords cheque of 50EUR and a toolkit with AdWords tips.
Initially I was planning to go as it may help me to get some affiliate campaigns started on AdWords but then I discovered that Google has published the presentations online. You can check out the beginner and advanced presentations at Google’s website.
Dollar drops to new record low
As oil jumped over $100 per barrel and gold reached new record heights of over $960 the U.S. dollar reached a new record low yesterday. For the first time since the euro was found in 1999 the U.S. dollar crushed the psychological barrier of $1.5 per EUR.
Analysts believe the Fed will further cut the intrest rates to fend off a recession in the U.S. and that’s causing the dollar to drop.
“The euro is trading above 1.50 against the dollar for the first time since the eurozone came into existence in January 1999,” said Global Insight economist Howard Archer.
“This is primarily a consequence of the dollar being undermined by further weak US data heightening concerns over the US economy and reinforcing expectations of additional interest rate cuts by the Federal Reserve.”
Analysts said the euro was boosted by the prospect of favourable interest rate differentials between the eurozone and the United States.
Speculators generally prefer to invest or hold currencies in countries where interest rates are rising or expected to rise in the hope they can increase their potential returns.
Soaring oil prices have diverted petro-dollar revenues into the strengthening European single currency, according to ABN Amro analyst Melinda Smith.
“In addition to the fresh widening in interest rate differentials, one of the key drivers of this move appears to be the surge of oil prices as petro-dollars are channelled into the euro,” Smith said.
When you take a look at the purchasing power the dollar is highly undervalued. According to an article I read in the newspaper today a euro is fundamentally worth only $1.1 to $1.2 instead of the $1.5 it’s currently trading at. I hope the dollar will rise again but it doesn’t really seem likely in this market.
Google’s paid clicks are dropping
Google’s stock took another big hit today on fears that it won’t be able to meet Wall Street’s expectations. Market research firm comScore published a report today that indicated that the amount of paid clicks on Google’s search engine dropped 7% month-over-month in January and remained relatively flat with the same period last year.
In its fourth-quarter financial results, Google indicated some concerns in this area, though at the time the company blamed the slowdown in paid-clicks to technical changes designed to reduce the number of accidental clicks by users.
Analyst Lee Westerfeld of BMO Capital Markets slashed his price target on Google’s shares to $590 from $690 in response to the comScore numbers, along with maintaining a market perform rating.
“The issue relates to the degree of multiple-compression risk under revenue- decelerating circumstances,” Westerfeld wrote in a report.
Robert Peck of Bear Stearns noted that the click-through rate was the lowest since comScore started reporting this type of data.
“While this is one data point for domestic google.com only and from one source, which may or may not be accurate, it is a concerning data point and somewhat reflects what we have heard from [search engine marketers] — that they were not seeing a high volume of clicks from consumers possibly due to the economic slowdown,” wrote Peck, who rates Google as outperform with a $650 price target.
Some analysts weren’t quite so worried. Marianne Wolk of Susquehanna Financial Group noted that Google is taking steps to improve the quality of its links and click-throughs, which may result in some lower revenue in the short term but improve the business in the long term.
A drop from December to January might be normal due to the holiday season but the fact that there was no growth compared to a year ago is pretty disappointing.
There could be several reasons for this:
- comScore’s data may be wrong.
- Google is trying to improve click quality to boost advertiser’s conversions which may eventually lead to higher bids per click
- A change in consumer’s behaviour due to the economic slowdown in the U.S.
- Companies may be reducing ad spending.
- Web users may be developing a text link blindness, just like with banner ads a couple of years ago.
Or it could be a combination of all five reasons. GOOG is currently trading around $457 which is one of its lowest levels since April 2007.

The LMA Rebuts a Critic
The following letter to the editor from Jennifer Johnson, president of the New York LMA chapter, appeared in the March 13 issue of the New York Lawyer. It came in response to an op-ed article by Elizabeth Anne "Betiayn" Tursi, Editor-in-Chief of ALM's Marketing The Law Firm. Among other points, Tursi wrote, " I dropped my membership because as time went on, I found the organization to be lacking the type of educational give and take that an organization is supposed to provide its members."
To the Editor:
We here at the Legal Marketing Association (LMA) find ourselves compelled to respond to the recent forecast of the death of our industry and alleged lack of leadership in our Association as outlined on this Web site on March 6, "Law Firm Marketing: R.I.P.?." It is clear to our members that this is anything but a field in decline. The facts point to just the opposite: law firm marketing is alive and thriving.
The LMA is a group of more than 3,100 marketing, business development and public relations professionals worldwide whose members are dedicated to growing the business of law firms globally. The Metro New York Chapter, with nearly 500 members locally, believes it is necessary to deliver hard facts not only to counter the provocative opinions of the author of the March 6 column, but to provide a clear and accurate picture of the reality of law firm marketing today.
The Association, in direct correlation with the industry of legal marketing, has grown more than 53% over the past five years due to law firm's investment in building more sophisticated platforms - many of which mirror those of their clients. What is the reason for such tremendous growth? It is because law firms have seen positive results in their bottom line. The firms who utilize marketing resources have seen increased efficiency with internal cross-communication resulting in more business from existing clients; brands that are differentiated from their competitors; increased partner business generation thanks to individualized marketing plans and coaching; geographic expansion due to the research of competitive intelligence teams; heightened realization rates because of improved matter management; and the list goes on.
A recent study by the author of this rebuttal shows that 61% of Chief Marketing Officers report to a Managing Partner or Chair of their firm. The average tenure for a Chief Marketing Officer was merely 18 months in 2005 and has grown to more than four years today. This compares favorably with other industries and can be taken as a strong gauge that marketing professionals are not only accepted, but very much valued by their firms.
Wait - there's more. Over the past five years the LMA has been led, whether at the International or Chapter level, by 24 c-level marketing professionals and by 125 director-level professionals, all of whom are volunteers. More than 30% of our members possess advanced degrees (which is a far cry from the days when firms plucked any warm body from the staff pool to lead marketing efforts). With 17 Chapters in the United States and Canada and members spanning the globe, the LMA has held approximately 1,000 events over the past five years that are not only educational but also afford important networking opportunities. These activities enable legal marketing professionals to learn from each other, form alliances and refer business which, ultimately, benefits their firms.
As to the substance of our educational efforts, the keynote speaker at today's LMA conference, for example, is noted attorney and human rights activist Cherie Booth Blair. After graduating with the highest honors from the London School of Economics, Ms. Booth Blair pursued a career as a practicing lawyer at Matrix Chambers Law Group in London while championing international causes along with her husband, then-Prime Minister Tony Blair.
As legal marketers, our mission is to ensure that our clients, the lawyers, are able to invest all of their energy and intelligence into providing the best possible service to their clients. With our help, lawyers have to worry less about where the next new matter will come from. It is the volunteers of the LMA who provide crucial resources to supplement the already marketing-savvy professionals in the industry.
If legal marketing as a profession is in decline, why are we able to point to so many successes? Ms. Tursi's column suggests that the law firm leaders who hire us, pay us and retain us are missing the mark. We could not disagree more. The increase in c-level positions, the diversification of roles within marketing departments and, frankly, the increased profitability of law firms in recent years can be attributed to the investment in legal marketing professionals.
The members of the LMA in discussion have been unable to grasp the motivation behind Ms. Tursi's comments, and we welcome a reasoned opposing view (we work for lawyers, after all),
But we will not stand by without responding to an attack that is not constructive, and we feel is blatantly without merit.

Ask the Oracle and Other New Blog Features
Yesterday I went a little crazy installing some new plugins for the blog. Most of these were on the administrative side, but there are some new public features as well.
There are thousands of WordPress plugins available, so it can take quite a while to sort through them to find the gems. One thing that helped me a lot was to do a Google search on “best wordpress plugins,” which brings up many sites with good compilation lists. It beats spending hours wading through the official WordPress plugins archive page by page.
Ask the Oracle
The simplest addition is a new Random Article link. This link also appears at the bottom of the “Best of StevePavlina.com” section of the sidebar, so you can access it whenever you want. I put a link to it in the RSS feed as well, so RSS subscribers can spontaneously ask the Oracle for advice whenever they want. It surprised me that this was one of the most requested features. I guess a lot of people want to use the Law of Attraction to manifest their answers. There are currently about 700 articles to choose from. Since it’s totally random, someone will click the link and get this article — will it be you?
Email this article to a friend
The blog articles now include an “Email this article to a friend” link. So far about 20 people have already used it. You can also use it to email articles to yourself as a reminder to read them later. This was another commonly requested feature.
Social bookmarking
Each article includes a “Share this” link, so you can quickly add any article to your favorite social bookmarking sites. You can also use this feature to send articles via email, AIM, MySpace, and SMS. This feature is available for RSS feed subscribers as well.
I looked into a lot of social bookmarking plugins, and I’ve used a couple different ones in the past. I like this one the best so far, partly because it reports general stats, so I can see which articles are getting bookmarked the most. This helps me recognize what people liked enough to save and/or recommend.
The most popular article on the site is still the ubiquitous How to Become an Early Riser, which is nearly 3 years old. I suppose if you want to work on personal development, the first step is to get out of bed.
Print this page
Sometimes people request a link to a printable version of each page, but there’s no need for one. Just go to any page on the site and click “Print.” You’ll get a nicely formatted printout with no navigation elements and no ads. If you’d like to see an example of how any page will look when printed, just use your browser’s Print Preview feature (File -> Print Preview… on most browsers). This is done by using a separate CSS file for printing. The site has included this feature for years.
If you know of other good WordPress plugins, please let me know. I don’t want to overload the blog with featuritis, but if there’s something people find really useful, I’ll consider it.

Google Earth Leads Geologist To Meteor Crater
Australian Geologist Arthur Hickman accidentally discovered a meteorite crater while using Google Earth looking for iron ore.
Dr. Hickman, from the Geological Survey of Western Australia sent the Google Earth picture to a colleague who was able to confirm that it was an undiscovered meteorite crater. The crater is now named Hickman crater.
The crater is believed to be between 10,000 and 100,000 years old and is 885 feet across.

User-Generated Site JD Supra Goes Live
Launched today, JD Supra offers lawyers a free platform to post official court filings and articles that can be accessed without fee by anyone using its site – www.jdsupra.com. It is one of the first Web 2.0 businesses designed expressly for the legal community.
“In a world in which YouTube and Google have established new rules for user-generated content and universal search, JD Supra hopes to redefine those two key concepts for the legal profession,” founder Aviva Cuyler said.

According to a recent study by Web research firm ComScore, more than 44 million people now use the Internet to research the law and seek legal services in their area. While most law firms have Web sites and many attorneys are active bloggers, JD Supra creates a central site where legal content is aggregated for easy research and one-stop shopping for legal counsel.
Attorneys who post content can create in-depth professional profiles highlighting their practice expertise and experience along with latest postings. The profile is available by browsing or keyword searching, as well as via link to posted documents. All documents are connected to contributor profiles.
